Please read this entire privacy notice (“Privacy Policy”) before using our websites, products, applications, and any and all other online services (individually and collectively, the “Services”).  Juran Institute, Inc. is a business solutions provider in the area of professional, consulting and online services.  This Privacy Policy describes how Juran and its subsidiaries and affiliates (collectively “Juran,” “our,” “us” or “we”) may collect, use and share information about you (“Personal Information”, as defined below) and what privacy choices you have when you use our Services.

Personal Information means any information relating to an identifiable person who can be directly or indirectly identified in particular by reference to an identifier including, by way of example and not limitation, the identifiers set forth below in Section 2.

By using the Services, you are accepting and consenting to the policies and practices described in this Privacy Policy.



  1.  COLLECTION OF PERSONAL INFORMATION

Through your use of the Services, we may collect Personal Information from you if you choose to provide it, including without limitation:

  1. Your name, email, username, phone number, company and address, (“Contact Information”);
  2. Your job function, salary, and status of your employment;
  3. Your credit card number, billing address, shipping address, security code and other payment transaction and verification details (“Payment Information”);
  4. Pages and products viewed, ads that you clicked on, emails from us that you opened, browser type, operating system, Internet Protocol address and device information (collectively, “Technical Information”);
  5. Publicly available information about you from third-party sources, such as the postal service for shipping address verification; and
  6. Your mobile device identifier or other commonly used mobile device identifiers.

 

We may collect your Personal Information from third parties, including without limitation:

  1. Your email address and other collected Personal Information about you may be forwarded to Juran by a third-party website when you request for Juran to contact you through such third-party;
  2. Your Personal Information may be forwarded to Juran when you choose to participate in a third-party application or feature, such as live chat, one of our social media pages or a similar application or feature on a third-party website;

 We will apply the terms of our Privacy Policy to any Personal Information received from a third party, unless we have disclosed to you otherwise.  Juran is not responsible for these third parties’ dissemination of your Personal Information.

  1. CHILDREN

 In compliance with the Children’s Online Privacy Protection Act, 15 U.S.C., §§ 6501-06 and 16 C.F.R., §§ 312.1-312.12, our websites and platforms do not permit children under thirteen (13) years of age to 



become users, and we do not intentionally collect Personal Information from children. By using our website, you represent that you are 13 years of age or older.



  1.  USE OF PERSONAL INFORMATION

We may use your Contact Information when you create an online account through any of our Services or register for any of our webinars of other online Services in order to communicate with you about the Services and your account. We may use your Contact Information to receive and respond to your questions about our Services and to communicate with you about the Services and/or any changes to the Services. 

We may use your Personal Information to determine what Services may be of interest to you, provide you with marketing communications (unless you have opted out of such communications) and to conduct market research. 

When you use the Services, we automatically collect and use Technical Information in order for us to continually improve your experience with our Services and to target marketing and advertising to you.

We may use your current location, provided address and/or zip code to provide you the location of the closest resellers of our Services or other appropriate information.

 

We may also use your Personal Information in other ways that are consistent with the above-described purposes in order to administer our websites and online platforms to provide our Services to you.



  1. PERSONAL INFORMATION STORED OUTSIDE THE UNITED STATES

Personal Information collected through the Services may be stored on servers inside or outside the United States. By using any of our Services, you consent to the collection, use, and disclosure of your information as described in this Privacy Policy, including the transfer of your information to Juran in the United States and other countries where Juran and its affiliates and subsidiaries operate. You may withdraw your consent at any time by contacting us at support@juran.com. Prior uses and disclosures will not be affected.



  1. EUROPEAN ECONOMIC AREA

If you are a resident of a country in the European Economic Area (“EEA”), the Personal Information we collect from you may be transferred to and stored at a destination outside the EEA. The Personal Information may also be processed by staff operating outside the EEA that work for us or one of our subsidiaries, affiliates, or third-party service providers. By submitting your Personal Information, you agree to this transfer, storing and processing. We take all steps reasonably necessary to ensure that your Personal Information is treated securely and in accordance with this Privacy Policy, and the safeguarding of the transfer of the Personal Information outside the EEA in accordance with the General Data Protection Regulation (“GDPR”) as applicable.



  1. PROTECTION OF PERSONAL INFORMATION

Juran maintains technical and organizational measures to protect your online accounts and Personal Information; unfortunately, due to the nature of internet transmission and electronic storage, no security methods are 100% secure or error-free, and Juran cannot and does not guarantee absolute security. You must prevent unauthorized access to your account and Personal Information by selecting and protecting appropriate password and other sign-on mechanisms and limiting access to your computer or other device and browser by signing off after you have finished accessing your Juran account.   



  1. COOKIES

 We use cookies (small text files transferred by us to your device along with related technologies performing a similar task), to help provide you with a more efficient use of our Services. The primary purpose of the use of cookies is to (i) remember your preferences such as your browser, account login information, and similar technical aspects of how you access our Services, and (ii) provide us with valuable information about how visitors use our websites and platforms, including which of our pages and products are viewed most frequently.

 

You can disable our cookies or all cookies through your browser settings. Although not all cookies and similar technologies that we use are required for you to use the Services, disabling these technologies altogether could prevent the Services from working properly and disable features that allow you to take full advantage of the Services we offer.



  1. PERSONAL INFORMATION WE MAY SHARE WITH THIRD PARTIES

Affiliates and Third-Party Service Providers. We may share your Personal Information with Juran’s subsidiaries, affiliates and other companies worldwide, including our resellers, contractors, and other Services suppliers in order for these companies to contact you about their products, services or other offerings that may be of interest to you. By accessing our websites, registering for Services with us, or otherwise providing us with your Personal Information, you consent to this transfer of your Personal Information worldwide as provided in this Privacy Policy. To choose to opt out of such disclosures, please email us at support@juran.com. This Privacy Policy does not govern unaffiliated third-party websites or any other website that does not link to this Privacy Policy.

 

Service to Juran Providers. We may share your Personal Information with affiliated and unaffiliated companies that perform tasks on our behalf related to our business. Such tasks include analyzing website or mobile application usage data, customer service, electronic and postal mail service, website administration, marketing services, social commerce and media services (e.g., Facebook, LinkedIn, Twitter et al.). Third-party service providers receive your Personal Information solely as necessary to perform their role, and they are not authorized to use your Personal Information for any other purposes.

 

As Required by Law. We will use and disclose your Personal Information as necessary or appropriate under applicable law, including laws outside your country of residence, (i) to comply with legal processes and to respond to requests from public and government authorities; (ii) to enforce our Services terms and conditions, including investigations of potential violations thereof; (iii) to detect, prevent or otherwise address fraud, security or technical issues regarding our Services; (iv) to protect our operations or those of any of our affiliates and subsidiaries; (v) to protect our rights, privacy, safety or property, and/or that of our affiliates and subsidiaries and clients and customers; and (vi) to allow us to pursue available remedies or limit the damages that we may sustain in any legal action.

Business Transfers. In the event that we may sell or buy assets, subsidiaries or business units to or from a third-party entity we may share and/or transfer your Personal Information with and to a third party in such transactions (including without limitation, any reorganization, merger, sale, joint venture, assignment, transfer or other disposition of all or any portion of our business, affiliates, subsidiaries or other assets). Any and all Personal Information that is transferred shall remain subject to any pre-existing applicable Privacy Policy.

Based on Your Consent and Non-Identified Data. We may share or disclose your Personal Information at your direction. We may share aggregated data where you are not identified (“Non-Identified Data”) with third parties.  Such third parties receiving Non-Identified Data and consented data include by way of example and not limitation tangible and digital publishers, advertisers and connected and unconnected websites.  We may also from time to time make this non-identifiable and consented data publicly available.  For example, we may share information publicly to show trends about the general use of our services or products. We may work from time to time with certain third-party advertising companies in connection with our online advertising, and those companies may set cookies or other tracking technologies in connection with providing advertising related services to us.   1. PUBLIC FORUMS

Our websites offer publicly accessible blogs, message boards, or community forums. Any information you provide in these areas may be read, collected, and used by others who access them. You may request removal of your Personal Information from any Juran blog, message board, or community forum by contacting us at support@juran.com, and we will make commercially reasonable efforts to remove your Personal Information from the identified blog, message board, or community forum. 



  1. SOCIAL NETWORKING AND OTHER THIRD-PARTY WEBSITES

 Our Services may from time to time contain links to social networking and other third-party websites. We do not take responsibility for the content or the privacy practices employed by other websites. Any Personal Information you provide to any third-party website will be collected by that party and not by Juran, and will be subject to that party’s privacy policy, rather than this Privacy Policy. Juran will have no control over, and shall not be responsible for, that party’s use of the Personal Information you provide to them.

  1. UPDATING YOUR PERSONAL INFORMATION

 If you have an online account with Juran or one of its subsidiaries and want to update the Personal Information you have provided in your online account, you can access your account on the Juran website where the account was created in order to view and make changes or corrections to your Personal Information. If you do not want to receive marketing emails or other email communications from us, you can use the unsubscribe method provided in our communications. We retain your Personal Information while you have an account with us and while you are using our Services or continuing to visit any of our websites.  We will retain your Personal Information for as long as it is reasonably necessary for the purposes set out in the Privacy Policy, considering the time period reasonably necessary to: provide the services to you; exercise the choices and rights you have requested; comply with our contractual obligations; enforce our terms for use of the Services; and, comply with legal and regulatory requirements. 

  1. EUROPEAN  DATA SUBJECT RIGHTS

If you are a resident of the European Union or other countries in the European Economic Area, you have certain rights that protect individual data subjects under the GDPR and other applicable data protection (“European Data Subject Rights”). Similar rights apply in Switzerland and will continue to apply in the United Kingdom regardless of EU membership. You may decline to share certain Personal Data with us, in which case we may not be able to provide some of the features and functionality of our services. If you give consent to use Personal Data, you may withdraw your consent at any time by contacting us (see below) regarding further processing of the Personal Data.  Your rights include, in accordance with applicable law, the rights to access or rectify Personal Data, object to or restrict further processing, or request the erasure of Personal Data or, where feasible, to have it moved to a new service provider (“data portability”).  Requests should be submitted by contacting us using the contact instructions below. 

You may access and change certain Personal Data by logging into our Site and updating the account settings page and other features. Otherwise, we will make commercially reasonable efforts to provide you reasonable access to your Personal Data within 30 days of your access request to the contact address below. We provide this access so that you may review, make corrections, or request deletion of your Personal Data. If we cannot honor your request within 30 days, we will inform you when we will be able to provide such access. If for some reason access is denied, we will provide an explanation. When technically feasible, at your request, we will provide your Personal Data to you or transmit it directly to another controller.

If you have any unresolved privacy concern that we have not addressed satisfactorily after contacting us, you have the right to contact the relevant national data protection supervisory authority and lodge a complaint.   1. CALIFORNIA PRIVACY RIGHTS

Under California’s “Shine the Light” law, California residents who provide Personal Information to Juran in obtaining Juran products and Services for personal, family or household use are entitled to obtain from us once a calendar year certain information (as specified in the law) about the Personal Information we shared, if any, with other companies for their direct marketing purposes.  If this is applicable to you and you desire to obtain this information please, send an email to  info@juran.com with “Request for California Privacy Information” in the subject line of the email.

Unless stated otherwise, our current Privacy Policy applies to all Personal Information that we have about you and your account.
